These Terms of Use (“Terms”) set out the conditions for using the app “Hum Memo” (“the App”) provided by 植木嘉朗 (“we”). By using the App you agree to these Terms. These Terms supplement Apple’s standard Licensed Application End User License Agreement; if they conflict, Apple’s standard agreement prevails. If there is any discrepancy between this English version and the Japanese version, the Japanese version prevails.
1. License
We grant you a non-exclusive license to use the App on your own devices for personal or commercial music making.
2. Your work
You own the rights to the audio, MIDI, and exported files you record or create with the App (“your work”). We do not receive your work and make no claim to it.
You may freely use and publish work made with the instrument sounds included in the App, including commercially. You may not extract and redistribute the sound files themselves.
If your work includes third-party material (someone else’s songs, lyrics, etc.), you are responsible for clearing the necessary rights.
3. Prohibited use
Reverse engineering, modifying, or redistributing the App (except as permitted by law)
Use for purposes that violate laws or public order
Use that infringes the rights of others
4. Your data
Your recordings and other data are stored only on your device, and we cannot access them. Export important work to keep a copy in case your device is lost or damaged or the App is deleted.
5. Changes to the App
We may add or change features, or stop providing the App. If we stop providing it, we will give reasonable notice, for example in the App Store description.
6. Limitation of liability
We do not warrant that the App fits your particular purpose or is free of defects.
Except in cases of our intentional misconduct or gross negligence, our liability for any damage arising from your use of the App is limited to the amount you paid us for the App.
If any provision of these Terms is held invalid under applicable consumer protection law, the remaining provisions remain in effect.
7. Changes to these Terms
We may update these Terms. Updated Terms take effect when posted on this page with a new effective date. We will announce material changes that are disadvantageous to you on this page in advance.
8. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Any dispute relating to the App shall be brought in a Japanese court having jurisdiction under the Code of Civil Procedure as the court of first instance.
